PARTICIPATION AGREEMENT
In consideration of IGBY Productions (IGBY) accepting my application to participate in the Debutante Ball activities at South Barwon Civic Centre and the VRI Hall, I acknowledge and agree that:
1. I will participate in the Debutante Ball and I will be bound by, and agree to comply with, the Debutante Ball rules and the rules, regulations, policies and directions of IGBY as they relate to the Debutante Ball.
2. All costs associated with participating in the Debutante Ball are to be paid in full by the due dates
3. Any person attending the Debutante Ball (including debs) under the age of 18, must be supervised by a responsible adult at all times
4. Fitness to participate: I declare that I am medically and physically fit and able to participate in the Debutante Ball.
5. Medical treatment: I consent to receiving any medical treatment that IGBY reasonably considers necessary or desirable for me during my participation in the Activities. I also agree to reimburse IGBY for any costs or expenses incurred in providing me with medical treatment.
6. IGBY reserves the right to refuse participation in the Debutante Ball for reasons, including, but not limited to, unpaid fees or monies, unruly or unacceptable behaviour, insufficient attendance of dance lessons
7. IGBY reserves the right to make any changes to the Debutante Ball, including, but not limited to, the date, group participants, venue, prices
8. IGBY reserves the right to cancel the Debutante Ball for reasons, including, but not limited to, insufficient number of participants, insufficient tickets sold, venue availability, any unforeseen circumstances beyond control
9. Right to use image: I acknowledge and consent to photographs and electronic images being taken of me during my participation in the Activities. I acknowledge and agree that such photographs and electronic images may be used by IGBY for promotional or other purposes without my further consent. Further, I consent to IGBY using my name, image, likeness and performance in the Activities, at any time, by any form of media, for any reason.
10. While IGBY takes all reasonable care in the conduct of the Debutante Ball activities, the participant agrees to Release and indemnity to the extent permitted by law:
(a) release and will release IGBY from any claim, demand, proceeding, damage, cost or expense (“Claim”) that I may have or may have had but for this release arising from or in connection with my participation in the Debutante Ball; and
(b) indemnify and will keep indemnified IGBY in respect of any Claim by any person arising as a result of or in connection with my participation in the Debutante Ball.
11. Warning: The Debutante Ball involves participation in Ballroom Dancing which is inherently dangerous. I acknowledge that I am exposed to certain risks during my participation in the Debutante Ball. I acknowledge that accidents can and do happen which may result in me being injured or even killed or my property being damaged. I have voluntarily read and understood this warning and accept and assume the inherent risks of participating in the Debutante Ball.
12. Miscellaneous: In this agreement:
(a) reference to IGBY includes, where the context permits, its directors, officers, employees, agents or contractors;
(b) if any provision is invalid or unenforceable in any jurisdiction, the phrase or clause shall be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable. If the phrase or clause cannot be so read down, it will be severed to the extent of the invalidity or unenforceability;
(c) the governing law is Victoria, Australia and the parties agree that the provisions of this agreement shall be construed in accordance with the laws, and they submit to the jurisdiction of the courts, of that state.
Debutante Rules
1. All participants must attend all dance lessons
2. Be punctual at all times
3. The Dance teachers, fellow debs and any other staff associated with the activities of the Deb are to be treated with
respect at all times
4. Any alcohol brought into the Deb will be confiscated and the person responsible may be ejected from the venue
5. Any person who arrives at the Deb under the influence of any drug or alcohol will be refused entry
6. Any damage to property will be paid for by those responsible
7. No participant is to consume or be under the influence of any drug or alcohol while at dance lessons
8. Any participant who is under the influence of any drug or alcohol at the Deb will be refused participation in the dances
and may be ejected from the venue.
Cancellation Terms & Conditions
1. Deb fees are to be paid in full no later than 8 weeks prior to commencement of dance lessons. 2. If the deb participant cancels within the 8weeks prior to commencement of the dance lessons deb fees are entirely sacrificed to cover costs and losses incurred by IGBY Productions. 3.If the deb participant cancels before the 8 weeks prior to commencement of dance lessons but less than 3 months 50% of deb fees are retained to cover costs and losses incurred by IGBY Productions. 4. If the deb participant cancels before the 3 months prior to commencement of dance lessons the $100 deposit is retained to cover administrative costs 5. The $100 deposit is non-refundable and non-transferable. 6. An administrative fee of $5 may be applied to changes made by the debutante participant, including, but not limited to; moving dates & changing partners.
